This week, the US House of Representative Committee on Energy and Commerce will debate the matters of the country’s disputed fantasy sports industry.

A hearing will take place on the 11th of May and it will feature input from a group of eight witnesses which has a different background and opinion on the future of daily fantasy sports in the USA.

According to a memorandum outlining the subject matter of the session, attendees will look at the four states that have passed legislation to legalise daily fantasy sports and discuss why 10 states have opted to classify it as illegal.

The attendees will also discuss the four federal laws linked to daily fantasy sports which outlawed online gaming in the USA, prior to new laws that enabled individual states to legalise internet gambling.

The session will also look at the current regulatory environment for daily fantasy sports at both federal and state level, the key customer protection matters for daily fantasy sports operators, the technology solutions that exist in the industry to ensure operators meet existing customer protection obligations and the varying products offered by daily fantasy sports brands and how they differ.

The memorandum said: “There have been varying responses to the growth of this marketplace from state legislatures, state Attorneys General, and state consumer protection regulators.”

“There is an ongoing debate in some states about whether or not the products offered by DFS operators fall within existing state gambling statutes.

“The DFS industry maintains that their products are sports entertainment products based on skill and not gambling.

“Other industries and government entities have challenged this position.”
